After a number of significant proposals in the committee stages, the Companies (Statutory Audits) Act 2018 has not changed the ability of companies who are late in filing an annual return to apply to the District Court to retain the audit exemption and avoid paying late filing penalties.

There has been some good news from the Select Committee Stage on the Companies (Statutory Audits) Bill 2017 which was debated on 21st February 2018. Minister Heather Humphreys has stated that the Department intends to examine removing the requirement to make an application to the District Court to retain the audit exemption. Niall Collins made representations regarding the impact on companies that face losing the audit exemption and the representations made by the accountancy bodies.

There is a slight irony in the publication of the Companies (Statutory Audits) Bill 2017 in the same week that the government announces plans to get tough on White Collar Crime. The new provisions are not as severe as what was originally proposed in the draft Scheme of the Bill.

This week will see the biggest test of the CRO’s filing system CORE. Approximately 50K companies will be required to file an Annual Return and upload its Financial Statements electronically. For some companies and practitioners this is a new departure from the manual system of filing annual returns and for many uploading the PDF financial statements electronically will be a completely new process.
CRO got a reaction they were probably hoping for when they sent out their email on 12th October 2017 announcing “CRIMINAL PROSECUTIONS HAVE BEEN COMMENCED “.
